Municipal Prosecutor
This is a Request for Proposal for Legal Services to act as prosecuting attorney for the Combined Silverthorne-Dillon Municipal Court.
SCOPE OF SERVICES
The scope of work for the Prosecutor includes providing a full range of Town Prosecutor services including, but not limited to the following:
• Managing and prosecuting all assigned cases including but not limited to:
o Preparation of pleadings.
o Representing the Towns in arraignments, bench trials, motion hearings, and other related trial work.
o Review of police reports and discovery.
o Handling pre-trial hearings and plea negotiations.
o Researching the law.
o Processing and preparing cases for trial as needed.
o Communicating in a timely manner with defendants and/or their attorneys, witnesses and victims, the Court Clerk, law enforcement, code enforcement, and other staff as needed.
o Presenting oral and written argument of legal concepts and principles.
o Working closely with the Court staff regarding administrative matters.
o Responding to discovery requests and motions of defendants.
o Drafting subpoenas, motions, notices, and proposed orders.
o Representing the Towns in appeals from Municipal Court.
• Conducting training as necessary for police officers and non-sworn staff regarding Municipal Court processes.
• Performing professional legal work carrying the highest levels of volume, complexity, consequence, autonomy, and responsibility.
• Identifying and recommending ordinances regarding municipal traffic and criminal offenses.
• Performing other duties as required by the Town Administrator and/or Town Attorney.
• In the event the Prosecutor has planned/unplanned absences, it is expected that the Prosecutor will provide a replacement to cover those absences.
• Caseload is primarily traffic cases (as well as some parking, shoplifting, animal offenses and other types of cases), and average approximately 10 - 20 cases per month. However, many traffic cases are resolved before the court appearance.
• Approximate hours required per month: 15-20 hours (varies depending on caseload and the unique needs of each case).
• It is expected that the Prosecutor will be able to devote appropriate time to each individual case as required.
EXPERIENCE REQUIRED/PREFERRED
• A law degree from an ABA-accredited U.S. law school is required.
• Minimum of five (5) years’ experience in criminal and/or administrative prosecution required.
• Experience in other areas of municipal law is desirable.
• Must be licensed to actively practice law in the State of Colorado and be in good standing with the Colorado Supreme Court.
• Must possess a valid driver’s license.
• Must have the ability to communicate effectively and diplomatically with Town personnel and officials, including the Municipal Judge, Municipal Court Administrator/Court Clerk, Chief of Police, law enforcement personnel, Code Enforcement personnel, defendants and their attorneys, and the general public.
• Must be able to develop a good working knowledge of Dillon and Silverthorne Municipal Codes, Model Traffic Code, Colorado Municipal Court Rules and the Colorado Rules of Evidence.
• Skilled in legal writing and research.
• Ability to use word processing and Court Management software and to do online legal research.
• Ability to perform with integrity; demonstrate honesty and sensitivity to ethical issues; and
avoid actual or apparent impropriety and/or conflicts of interest.
• Ability to exercise appropriate judgment, often under pressure, consistent with the highest levels of volume, complexity, consequence, autonomy, and responsibility attending the position.
